Americans should always know their health information is secure.\u201d<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><b><u><span style=\"font-size:14.0pt\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">BACKGROUND:<\/span><\/span><\/u><\/b><span style=\"font-size:14.0pt\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\"> Under current federal law, the Health Insurance Portability and Accountability Act (HIPAA) protects all interactions between patients and their doctors. HIPAA does not, however, protect health data recorded on personal devices which puts this data at significant potential risk.<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:14.0pt\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">More specifically, the <i>Smartwatch Data Act<\/i> defines what data is protected under the law. The bill would prevent entities that collect consumer health information from transferring, selling, sharing or allowing access to consumer health information or any individually identifiable consumer health information collected on personal health trackers.
