WASHINGTON, D.C. <\/strong>\u2013 Today, U.S. Senator Jacky Rosen (D-NV), a member of the Senate Committee on Health, Education, Labor and Pensions (HELP), joined her Democratic colleagues in the Senate to introduce a Congressional Review Act (CRA) resolution to combat the Trump Administration\u2019s efforts to strip away pre-existing condition protections for millions of Americans.<\/p>\n

\u201cThe actions by this Administration to push junk health care plans will limit access to quality care, and in some cases, invalidate protections for those with pre-existing conditions, leaving the health of countless people in Nevada and across the country in jeopardy,\u201d dijo el Senador Rosen.<\/strong> \u201cMy colleagues and I refuse to sit on the sidelines while health care coverage for millions is put at risk, and this CRA resolution will force a vote to protect our nation\u2019s care. I will continue working on commonsense policies that protect Nevadans\u2019 access to quality, affordable care.\u201d <\/p>\n

BACKGROUND:<\/strong><\/u> The Congressional Review Act (CRA) resolution, supported by all 47 Senate Democrats, would roll back the 1332 waiver rule \u2013 a Trump Administration effort to sabotage Americans\u2019 health care and threaten the 130 million Americans who stand to lose pre-existing condition protections. Senate Democrats can force a majority-threshold vote on this CRA resolution later this fall.<\/p>\n

As one of her first actions in the Senate, Senator Rosen joined Senator Joe Manchin (D-WV) in introducing a resolution<\/a> that would authorize Senate Legal Counsel to intervene in Texas v. United States \u2013 a pending lawsuit in federal court, on behalf of the U.S. Senate, in order to defend the constitutionality of the Affordable Care Act and its coverage protections for people with pre-existing conditions. Earlier this year, the Trump Administration filed a brief in this case calling for the courts to strike down the ACA in its entirety. <\/p>\n

Last Congress, then-Congresswoman Rosen introduced the same resolution in the House. Rosen\u2019s House resolution was co-sponsored by the Ranking Members of all House committees of jurisdiction in addition to Democratic Leader Nancy Pelosi and Democratic Whip Steny Hoyer. The resolution had nearly 190 co-sponsors by the end of the 115th Congress.<\/p>\n

In March, Senator Rosen also helped introduce a resolution<\/a> that would provide the sense of the Senate that the Justice Department should reverse its policy of refusing to defend the constitutionality of the ACA, including the law\u2019s coverage protections for those with pre-existing conditions, in Texas v. United States.<\/p>\n
