WASHINGTON, D.C. – U.S. Senator Jacky Rosen (D-NV) joined Senate colleagues in filing an amicus brief in Oregon v. Department of Homeland Security, a lawsuit brought by 12 states – including Nevada – against the Trump Administration’s illegal use of emergency powers to impose broad, cost-raising tariffs. The case before the U.S. Court of Appeals for the Federal Circuit is an appeal of a decision last month by the U.S. Court of International Trade ruled that the Trump Administration lacked authority to impose these tariffs under the International Emergency Economic Powers Act (IEEPA) — a statute no previous president had used for such measures. The senators argue in their brief that the lower court correctly ruled Trump’s actions to be illegal and that continued implementation of these tariffs would cause immediate and significant harm to small businesses nationwide.
“Donald Trump’s reckless tariffs are raising costs for hardworking families and hurting small businesses by creating economic uncertainty,” dijo el Senador Rosen. “The Constitution and federal law give Congress, not the President, the authority to regulate trade, and I’m urging the courts to reaffirm Congress’ constitutional and statutory authority. I’ll keep fighting to repeal Trump’s sweeping, cost-raising tariffs.”

Senator Rosen has helped lead the fight to oppose Trump’s reckless tariffs. In March, she helped introduce the Tariff Transparency Act, which would require the U.S. International Trade Commission to study and publicly report on the economic effects of tariffs on Canada and Mexico– key trading partners for Nevada industries. In May, Rosen voted in the Senate to pass a bipartisan resolution aimed at overturning Trump’s cost-raising tariffs—a move she emphasized was essential to protect Nevadans from rising prices on everyday goods and to shield small businesses and the tourism industry. Unfortunately, this was voted down by Senate Republicans. She also recently helped send a letter urging the FTC to investigate whether corporations were using tariffs to justify price hikes on consumers. Senator Rosen’s multi-pronged approach, combining legislative proposals and consumer advocacy, highlights her commitment to stand up for Nevada families.
